On the reference of Maoist people’s war

 Human rights: what seen in Rolpa !!!

March 27, 1998 / New Plaza, Putalisadak, Kathmandu.

INHURED International and the National Concern Society jointly organised a interaction programme on "Maoist People's War and the role of local bodies to preserve the Human rights" at the DDC hall, Liwang, the district headquarter of Rolpa on 22nd of March 1998. While addressing the interaction the former speaker of Parliament and Constitution draft person, senior advocade Damannath Dhungana said the Maoist People's War which initiated in different parts of the country including most affected Rolpa is the outcome of the Eatist (Khaobadi) tendency of the present state power-holders, and he clarified that the Eatist (Khaobadi) means exploitation, repression of people, corruption, treasoning, and the lack of political innocent. He told unless the Eatist end, the Maoist problem will not be solved, it is a serious political problem. So, he demanded the government must initiate the dialogue process immediately in a formal way. Padmaratna Tuladhar, a member of parliament and the co-ordinator of ‘Save the Democratic Rights Movement’, said the government is seriously violating and discriminating the constitution and laws and carrying out the anti-people activities by killing and suppressing the innocent people, physically and mentally torturing and trapping the people in false charges. He added the Maoist people’s war is a political problem, so, it should be solved through the dialogue and all party discussion.

“The Maoist problem can not be solved by suppression” said another speaker Chetendra Jung Himali, advisor of the Society and the secretary general of the Green party Nepal. The economic, social and political wants and necessities of the people are taking horrible shape. The government should guaranty these and should not see the problems in a prejudice. Likewise, Kamal Prasad Malego, a human rights Lawyer appealed human rights followers and lawyers to fight against the false charges and imprisonment. The other commentators Tikaram Oli- secretary CPN (ML) Rolpa; Madhav Aryal, Chairman, Nepali Congress, Rolpa; Mrs. Tulasa Dhakal, wife of the tortured imprisoned victim teacher Mohan Dhakal, Salyan( she was in Rolpa to find her husband and just three days before he was disappeared from the Rolpa prison: fact from the visit of Rolpa prison and locals who saw him taken away); and Mrs. Bhim kumari Budha etc. also commented their own opinion about the Maoist People's War and the human rights violation during the suppression and its generated problems.

As a representative of His Majesty the Government's home ministry, chief district officer Purna Bahadur Adhikari spoke he didn't give any order to torture anybody during his short assignment in Rolpa, (referring to the claimed during our visit) and he expressed that to solve the maoist problem should win the heart of the people politically instead of oppression. Inspector Mohanraj Joshi from the district police office, as a representative of police headquarter claimed "it is impossible to carryout and follow the legal processes due to the massive byecut to the police. To drink water from the house of people, we should use rifles, there is complete lack of witnesses of police cases in the district". In response of the tortures he added "without tortures crime can not be committed, it is not possible to suppress the Maoists by following or respecting the present constitution and laws, and emphasised to introduce a "terrorist act". All the participants and speakers resisted and expressed their disagreement with the Inspector Joshi's irrespective and anti-constitution, laws and expressions against the national as well as international Laws.

At the beginning of the programme, Gopal Siwakoti 'Chintan' executive director of INHURED International and the secretary general of National Concern Society presented a document paper of international Laws which declared by UN and ratified by Nepal are valid as compulsory national laws for those authorities who implemented law here.

The second day, 23rd of March, We visited, discussed and recorded the interviews in details with the 72 prisoners, all the victims of tortures in Liwang prison (jail) and observed the very poor and inhuman jail situation also. At the afternoon, in participation of above 2000 locals, teachers, government officials, politicians abroad mass meeting (speeches and question-answering) successfully held at the Liwang stadium on the subject “Maoist people’s war and the problems and solutions of the human rights violations”. The programme chaired by Hari Prasad Acharya, chairman of Liwang village development committee and was moderated by Gopal Siwakoti “Chintan”. The programme was started with the well-come, speech of Janak Pathak, a journalist and representative of National concern society and INHURED International and stated the necessityand objectives of the programme. At the well-come speech, he said the state is not only violating the constitution which we got from the 1990’s people’s movement but also committed to crimes according to international laws and declarations. When the state becomes killers, when state exercises to make trouble the people, there is no alternative of revolution. The people of Rolpa and around the country who are using the guaranteed rights by the UN universal declaration through “rights to rebel” is only the way for the liberation, where people should watch the police to save their life from the fear of killing, torture, rape, pillage etc: One day people would be able to punish correctly those who are playing ´holy` in our blood. We should teach the people to fight and up-rise against the barbaric repression and state terrorism. Where police is defining their human rights means to kill the people and whatever they like/need to do, there democracy is not possible even in dream also. So, the war is forced by the state, and approved by people with the massive participation and support which we saw here. The war was not, is not and would not be the interest of people. But during the past 5 years of democracy, the police killed hundreds of daughters and sons of the masses thousands others imprisoned in false charges and forced to hide tens of thousands, then they started to reject all those police activities and develop as people’s war.

At the programme the former speaker of house Damannath Dhungana addressed “the political difficulties and problems created, the inhuman tortures to the prisoners, false charges, and the events of extra judiciary killings by police with violating the democracy and the constitution achieved by the people’s struggle. He claimed that there are serious violations of the human rights guaranteed by the constitution and demanded to takehard action against those police and authorities who discriminated laws and tortured with immediate compensation to the victims. Likewise, Padmaratna Tuladhar, MP and former minister said “it is natural to be revolt after the suppression and injustice by the government and the main responsibility should take the government. He further added “to solve the Maoist problem, it should be solved the economic, political and social problems of the people and should be able to create the public belief by the government. Shakti Lamsal, senior journalist and the member of the National People's Movement Co-ordination Committee expressed "the wave of the people's war created against the existed economic, political, social and cultural problems, the Imperialist and expansionist oppression and exploitation, the loots and suppression of the feudals, small hilly kings and the police administration protected from the palace; the repression never can be a long-term solution of the problem. He accepted people's war is a political war and demanded to treat according to the Geneva convention on the internal conflicts and the protection of the innocent citizens from government.

At this mass meeting, co-ordinator of the national resources and people's rights preservation civil committee, Pokhara, and advisor of the society Teknath Baral, secretary general of the Nepal Green Party Chetendra Jung Himali, literature writer and the professor of Prithvi Narayan Campus Bhawani Prasad Pandey and intellectual and human rights defender Dr. D.B. Singh said the people's war was declared as a protracted people's war and emphasised not to continue to break laws and state terrorism in the name of suppression in any condition by force. Chintamani Aryal, National council member of (Rastriya Prajatantra Party) RPP residence of Liwang and Jit Bikram Malla, chairman of Nepal BAR Rolpa, demanded to stop the illegal activities of the government and asked to release all who are trapped on fake charges on the process of the suppression of the Maoist people's war with emphasised on the political solution.

The formation of the first Branch of INHURED international

Likewise, on the 23rd of March, the gathering of the different independent individuals involving in different professions and businesses decided to form a Rolpa Branch of INHURED International to protect and respect the basic and fundamental rights guaranteed by the constitution of Nepal, International Humanitarian Laws or 1949 Geneva Convention on the Laws of Armed Conflicts. The work distribution of the committee is as following:

It is mentionable that the Rolpa branch is the first district Branch of the INHURED International. All the participants of the field study and observation team welcomed and promised to help in every prospect to the initiatives of the people of Rolpa for the Human rights protection.

Likewise our observation team visited the locals, workers of political parties, intellectuals and human rights activists in Khalanga, Bijuwar, Bgdula and Jhimruk of Pyuthan District on 24th of March. The district headquarter of Pyuthan, Khalanga we visited the prison and observed the conditions there. It was founded very inhuman and neglected by the state. A lot of prisoners were trapped in false charges created by the police. In Jhimruk we visited the hundreds of victims of the Dam construction for hydro-electricity. We observed some of the affected parts of the dam and held a short interaction programme.

The next day on 25th of March/ we organised a press conference and a programme to publicise what we saw in ´Rolpa` in Butwal, a city of Lumbiny zone. We also participated in an interaction programme initiated by intellectuals, journalists, lawyers there. We showed Video and audio recorded in Rolpa prison and programme there. Which was far more effected, because it was a first initiatives without biasness and exposed the state terror and other realities of state propaganda.

26th of March we participated in an interaction programme organised by intellectuals and Human rights activists in Narayangadh, a zonal centre of Narayani. In interaction programme we exchanged the observations with the team which visited Gorkha and Dhading some days ago. The local and national media also represented the programme. Later we visited the Gandaki irrigation cannel and Indian effects to its manages. We also visited the local defend committee of the effect from the Vrikuti paper mills which not only spreads pollution in air but in the Narayani River by its direct outlet. At all these meetings and programme the local participants expressed their happinesss and concerns to the initiatives of the field observation team and provided valuable suggestion to solve the problem which people are facing to the government.
