Introduction

Nepal is a semi-feudal and semi-colonial south asian country. It is second poorest country of the world. More than seventy five percent of the population are forced to live under absolute poverty line. The 90 percent people are living in countryside and involving on agricultural works . But only five percent higher class people holding 45% of land and 70% of people have only 20% of its land. Hundreds of peoples are forcing to work as bonded labour. The production technology also in primitive stage. On the other hand all the market economy is controlled by bureaucratic and comprador bourgeousie. For example, more than eighty percent of foreign trade and industries are owned by indian or indian origin businessman. The so called market economy is the way of peoples exploitation. National bases of development resources are under control of india through forced unequal treaties which are totally against of Nepal e.g.- the "sugauli-treaty". This treaty was forced by the British-India government in 1816. Through this treaty the Britishers hired the Nepalese military and continue the provision of recruiting nepali people in Indian army and now in british-gorkha regiment also. In 1923 there was another trade treaty which forced Nepal to become a Indian captive market. After the independence of India the Indian state power followed the British imperialistic character and continued not only the last unequal treaties, they forced to sign in several treaties and agreements which are sarad dam, Koshidam ,Gandaki river Mahakali river and etc.

The state power is holding by the Shah family since the half of eighteenth century. The Nepali people had been suffered through 103 years Rana resime. After the rana resime people of Nepal had expected of development and changes of social and economic structure. But they could not get anything except the new and systematic way and method of exploitation. After the unequal treaty of 1950 the share of government have divided among feudal, bureaucratic and comprador class and they started to exploit in the name of democracy. In 1960 the King Mahendra changed its name to panchayaty democracy. Since 1950s the reactionary state power has changed it's slogans, forms and appearances continuously up to this time when one becomes and appears nakedly complete failed These packets of illusion are: land reforms programme, the muluki ain (this is a act which is announcing as a way to change the living standard of people) , new education planning, rastriya gaunpharka abhiyan (national campaign to return village), janamat-sangraha, asiyali-mapdanda , programme for fulfilment of basic needs, re-establishment of constitutional monarchy and parliamentary democracy etc.. Every programme made additional trouble for the country. Before this Nepal had nearly thirtieth position from the below but after these programmes it has second position. All these programmes are planned and implemented under the direction of world imperialism and Indian expansionism through reactionary classes. On the results of those economic and political implementation Nepalese people are exploited and suppressed badly and the national resources are captured by the world imperialism and Indian expansionism through the feudal bureaucratic comprador class collaborated reactionary state power. Nowadays Nepal is completely becoming as a captive market of Indian expansionism and American imperialism.

After the reestablishment of parliamentary democracy, people hoped to get social security, economic development or the development of living standard, equal rights and opportunity for religious, cultural, linguistic and other socio-political rights.. but instead of all these rights His Majesty the government (the state power) slipped out from all these points and practised to make institutionalize the corruption , commission, murder, rape, loot, smuggling unlimited exploitations and suppressions of peoples voices etc.: fruits of this kinds of democratic practices destroyed the peoples' living. So people demanded and came out to fulfil basic needs, to control unlimited growth of prices and to provide social security, peace and justice; but the government always neglected all these voices. The police suppressed peaceful demonstrations and meetings. The government used their forces through unresponsible manner, that's why the police killed two and half years, six years child and dozens of freehand people. The government systematically mobilized the state power to eliminate the leftists. They arrested thousands of members of "united peoples' front", imprisoned and trapped on fake cases. Among them elected representatives were also affected in big numbers. All the reactionaries and revisionists became together to suppress the revolutionaries. This way the feudal, bureaucratic and comprador bourgeoisie becoming richest and richest, on the other hand about 90% of people are getting poorer and poorer. It shows that the class conflict was reached in a absolute situation and there was not any alternative of revolution to solve the problems.

When the reactionary state power becomes in to crisis they always put the people in illusion. The previous history of peoples' movement is ending after renew or redistribution among their sub-division. Or ending in suppression because people had not their own military force. But, now, the Nepalese people are being fighting under the leadership of Nepal Communist Party (Maoist). NCP (Maoist) took initiation of protracted peoples' war in Nepal on february 13,1996 (falgun - 1, B. S.. 2052) to bring total structural change in to socio-economic and cultural structure. The peoples war is guided by the scientific theory of marxism-Leninism-Maoism in Nepalese context. At first day of initiation

The first strategic aim is to establish and build a people's New Democratic state in a preplaned clandestine move selected targets of police out-posts, state owned agricultural development bank office , factory of multi-national company, brewery of a comprador bourgeois and premises of a local feudal-usurer were systematically attacked and properties thereof seized, as a symbol of rebellion and to herald the initiation of people's war on that historic day. Together with these, the party arranged hundreds of marches, hundreds of thousands of revolutionary leaflets & posters were distributed throughout the country to speed the political massage of the historical rebellion among the general masses of the peoples on the same day. The reactionaries and revisionists were caught totally unaware of all these preparations and initiations and they were just appalled and dumbfound at first. Only after a weeks did they have realized the severe tremors and thunder in their Heaven of class exploitation & plunder, and they let loose their brute state force against the revolutionaries & the masses in a state of mad frenzy. The prime minister and the home minister announced we would be controlled in about a month. At the same time the revisionists of different trade marks also remarked that they would finish within three months romances. But, instead of all those statements and suppressions campaign the NCP (Maoist) successfully faced the state terrorism and developed the people's war in a new quality of continuation. the government not only failed to repress, they became in to crisis. They were criticized from every sides, so they came to announced it is a political problem and wanted to solve politically through table talks. But it became to prove it was a illusion and way to prepare another big military operation. During these two police operation the police took the law at their hand and created unlimited situation of murder, loot, rapes of state. The human rights organizations, independent press and democratic parties and institutions spoke against the terrorist activities of the state. To solve this kinds of inability the reactionary state played a role to bring in to one front to the all opportunists, revisionists and other reactionaries, as a results the new coalition government formed among the new reactionary group of NCP (united marxist, leninist) Royalist party of RPP and pro-Indian sadvawana party, which all are known as pro-Indian lobby. In a short time this coalition also became failure and again they tried to another ways. But ultimately they came to the another popular measure of general election to abuse and to repress the people's war. During all this time they applied and increased the military way of suppression, Through the white terror the bloody state power wants to save their heaven of loots although the people's war is lifting upward after every sphere of reactionary step.

The government of nepal violating the constitution of 2047, which was achieved with the sacrifices of nepalese sons and daughters through the people's movement of 2046. The constitution of nepal guaranteed the right of life, peace and justice, free from torture, right of beliefs and respects of universal declaration of human rights. But in practice they never respected the law. They always arrested the people without warrant even there is banded to arrest without legal provision. Even those peoples are being imprisoned, tortured and killed who were decided to released respectfully from the different courts. The former speaker of parliament and the member of constitution construction commission mr. Damannath dhungana claimed after his visit of rolpa districts with a team of human rights there is not any government and the rule of law, because of the state terror. At that occasion the chief district officer purna bahadur. and police officer also said here the law is not functionable and there is not any possibility to work with law and justice. During the visits of human rights fact-finding mission the only the police officers demanded to construct a new laws which will provide the rights to kill the masses without any barrier. After that, the time of so-called communist participated coalition government proposed act 'anti-terrorist act' through it's communist home minister Bamdev Gautam. But it could not table because of the joint protection of patriotic and democratic powers. The failure of these trick the government is directed from it's top (i.e. The military leader and imperialist specially the Indian expansionism) and continue to suppress the revolutionary forces and masses. The search and kill- operation-2, is the latest and bloody crime of the reactionary state power. They flowed the blood of innocent and revolutionary peoples but it carried the public opinion against them and politically they became into defending position. It shows the suppression never could be success to check the revolutionary struggle which is guided by the correct ideology of people-marxism-leninism-maoism.

The peoples' war in nepal is going upward on it's higher stage of the formation of revolutionary base areas where the peoples are practising the New Democratic state power at the local level. In the other hand the reactionary state announced a acts through it's parliamentary theatre after the DRAMA of general election of may, 1999. This act provided the rights for bureaucrat chief of district to arrest, imprison and to announce corfue for unlimited time. Everything is depend upon the intention of police. This act is against the constitution of Nepal and maximum black, cruel and worse in the history of Nepal according to the intellectuals, observers and the experts of laws. This issued provides the proof of the victory of the peoples and the reality of reactionary slogan of democracy and human rights.
