Hussein Daoud zu zwei Jahren Gefängnis verurteilt

Am 20. März 2002 wurde der syrische Kurde Hussein Daoud zu einer Gefängnisstrafe von zwei Jahren verurteilt. Er befindet sich jedoch bereits seit seiner Abschiebung aus Deutschland im dezember 2000 in Haft. Nach seiner Verhaftung galt er als verschwunden, niemand konnte etwas über ihn in erfahrung bringen.#

Erst infolge der Proteste der Kurden in Deutschland sah sich die Bundesregierung gezwungen zu handeln und übte Druck auf die syrische Regierung aus, woraufhin am 26. Juni 2001 Vertretern der Deutschen Botschaft gestattet wurde, Hussein Daoud im Gefängnis zu besuchen. Im September konnten ihn schliesslich seine Eltern besuchen. Bei den Bersuchen musste in Erfahrung gebracht werden, dass man Hussein Daoud schwer gefoltert hatte. Ohne die Proteste in Deutschland wäre Hussein Daoud inzwischen wahrscheinlich tot.

Nach nahezu eineinhalb jahren Inhaftierung ohne jeglicher rechtlicher Grundlage, wurde Hussein Daoud in einem zweifelhaften Prozess schliesslich zu zwei Jahren Haft verurteilt. Das Urteil begründete sich auf sein Engagement für die Kurdische Volksunionspartei in Deutschland. In Deutschland hingegen hatte Die Gerichte sein Engagement für die Partei für nicht asylrelevant befunden.

Amnesty International stuft Hussein Daoud jetzt als politischen Gefangenen ein und ruft zu einer dringlichen Fax- Aktion auf. Wir möchten uns dieser Aktion anschliessen und rufen dazu auf, einen Brief, ein Telegramm oder ein Fax an Bashar al-Assasd (Adresse unten), mit der Forderung nach seiner unmittelbaren Freilassung und nach einer unabhängigen Untersuchung bezüglich der an Hussein Daoud begangenen Folter, zu senden.

On 20 March, Hussein Daoud, a Syrian Kurd who had been in detention since December 2000, was sentenced by the Supreme State Security Court to two years in prison  followin an unfair trial. Amnesty International considers him to be a prisoner of concience detained solely for exercising his right to freedom of expression and association.

Hussein Daoud was charged according to the provisions of Article 287 of the Penal Code and Article 3 of Legislative Decree number 6 of 1965 for "involvement in an attempt to sever part of the Syrian territory" and "opposing the objectives of the revolution through taking part in demonstrations". the charges areapparently related to Hussein Daoud's involvement with Kurdish opposition groups abroad, which the Syrian authorities consider to be seperatist organisations intend on dividing the country. In a letter to Amnesty International dated 6 February, the Syrian authorities stated that Hussein Daoud was involved with the Kurdish People's Union Party which is prohibited in Syria.

Hussein Daoud was arrested by the security forces at Damascous airport in december 2000 on his arrival from Germany from where he was deported following the rejection of his asylum application. He was initially held at Far' Palastin Detention Centre where he was interrogfated about his political activities in Germany. He was then held incommunicado for months at various detention centres in Damascous and al-Quamiahli in northern Syria, where he was reportedly tortured. On 26 June 2001 the authorities allowed a representative of the German embassy in Damascous to visit him at Sednaya Prison, on the outscirts of the city, where he is currently held.

FURTHER RECOMMENDED ACTION: please send appeals to arrive as quickly as possible ... :

  • calling for the immediate and unconditional release of Hussein Daoud as Amnesty International considers him to be a prisoner of conscience detained solely for his peaceful exercise of his right to freedom of expression and association,
  • calling for an independent investigation into the allegations of torture, for the results to be made public and those responsible to be brought to justice.
